Landlords. EPC laws have changed, are you ready?

As of 1st April 2018, new legislation under the Energy Efficiency (Private Rented Property) (England and Wales) Regulations 2015, means that if your rental property has an Energy Efficiency rating of band F or G, as shown on a valid Energy Performance Certificate (EPC) for the property, it will be against the law for you to grant a tenancy to new tenants or renew/extend a tenancy agreement with existing tenants.

As of 1st April 2020, you must not continue to let a sub-standard rental property to existing tenants, where there has been no tenancy renewal, extension or indeed new tenancy. Once this law comes into force, energy efficiency improvements will have to be made if you wish to continue renting out your property. A civil penalty of up to £4,000 will be imposed for breaches, although in some circumstances exemptions may be possible.

An EPC is a certificate issued by an authorised Domestic Energy Assessor, which is valid for ten years. The certificate is illustrated by two graphs that highlight the energy efficiency and environmental impact of the building in question. These are very similar to the graphs found on a new fridge or car. Rated from A-G, where A is the most efficient and G the least efficient, the graphs are designed to raise awareness of the environmental issues associated with the property in an effort to help us become more environmentally aware. The certificate also contains recommended ways of improving your property’s energy performance and whether certain financing or grants may be available to improve the energy efficiency too.
